1. Quotations
Written quotations are firm for 10 business days unless they state otherwise. Prices are per unit, exclusive of freight unless the quote says “delivered”, and exclusive of sales tax. Verbal indications are not quotations; if it is not in an email from us, it is not a price.
2. Grades
Our grades are defined terms, not marketing adjectives, and every unit we ship is graded before it is loaded:
- Grade A — food-grade eligible or rebottled. Clear or near-clear bottle, documented edible prior service or a new bottle, new valve, new gaskets, new lid, re-marked.
- Grade B — washed industrial. Sound bottle with staining or haze permitted, straight cage, new or sound valve, leak tested, suitable for non-potable industrial liquids.
- Grade C — rinsed, as-is. Structurally sound and watertight but cosmetically marked; sold for non-contact storage, water, upcycling and site use.
- Cage / pallet only and scrap are sold expressly without liquid-holding warranty.
3. Prior contents
When you sell totes to us you warrant that the prior-contents declaration you give is accurate and complete, that the units are empty to drain, and that they have not held a substance requiring specialist decontamination without telling us. We refuse acutely hazardous waste residues, unknown mixed residues, pesticide concentrates outside the labelled rinse programme, and anything radiological. Misdeclaration makes you liable for the cost of handling, disposal and lost line time.
4. Fitness for purpose
You are responsible for deciding whether a given grade suits your product. We will tell you what a tote held and how it was cleaned; chemical compatibility, regulatory eligibility and food-contact decisions remain yours. We will not sell an industrial-prior tote as potable, and we will recommend a rebottled unit when that is the honest answer.
5. Freight, title and risk
Unless agreed otherwise, title and risk pass on loading at 310 Emig Rd. On delivered orders we arrange carriage as your agent; claims for transit damage must be noted on the delivery receipt at the time of unloading. Appointment windows are indicative — we will tell you the moment a lane slips.
6. Inspection window
Inspect on arrival and tell us about a grade dispute within five business days, with photographs. We will replace, re-grade or credit. After five days the shipment is accepted as graded.
7. Warranty
Reconditioned and rebottled units are warranted leak-free on delivery and for 30 days of normal service with a compatible liquid. Grade C and as-is units carry no warranty beyond being watertight at the time of loading. No warranty survives modification, over-stacking beyond the rated load, exposure beyond the UV life of the bottle, or filling with an incompatible substance.
8. Leases
Leased units remain our property. You are responsible for returning them empty, rinsed and in the condition issued, less fair wear. Replacement charges for lost or destroyed units are stated on the lease schedule before it starts.
9. Payment
New accounts prepay; approved accounts are net 30. Purchases of your empties are paid on weight-and-count confirmation at our yard, by ACH, within five business days.
10. Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, and the courts of York County have exclusive jurisdiction.
